General Terms and Conditions

The following general terms and conditions apply to the use of the internet offers of the cosmopop GmbH, Ludwigshafen, and all resulting contractual relations with users and customers.

1. Contracting Party

The contracting party is the cosmopop GmbH, 67061 Ludwigshafen.

2. Conclusion of a Contract

The offer for the conclusion of a contract is effected by the customer. The approval of an order is given by the registering of all relevant details in the order form and posting of these by the pressing of "send".
A conclusive contract is effected by the cosmopop GmbH by the confirmation of the order and sending of an invoice.
The customer must be of age and allowed by law to conduct transitions. If this is not the case, the permission of a parent or guardian is needed.

3. Prices

All prices are - if not specified otherwise - gross unit prices in euro and include value-added tax at the current rate. Value added tax is disclosed seperately.

4. Delivery

The delivery of the ordered goods takes place while stocks last and/or up to a fixed dispatch date which guarantees a punctual delivery.
The delivery of ordered goods will take place at the customers' risk and cost.
The dispatched goods remain property of the cosmopop GmbH until the time of delivery and encashment. This applies to all available payment options.
Obvious damages in transit and visible defects and/or differences in quantity must be immeadiately indicated, at the lastest within 3 working days of recieving the goods at their place of destination, by phone, in writing, or via email at info@cosmopop.biz. Otherwise, notice of defects shall be ruled out.

5. Payment

Delivery takes place via cash on delivery and advance payment (by bank transfer). Cash on delivery orders are to be paid in cash to the parcel service on arrival. Advance payment orders must be paid by bank transfer prior to the dispatch of the ordered goods.

6. Retention of Title

All deliveries shall be effected exlusively under retention of title. Ownership of the goods will be transferred to the customer only when the customer has met all requirements arising from the contractual agreement.

7. Right of Withdrawal or Return

According to legal right of withdrawal, a cancellation of contract is possible until up to 14 days after recieving delievered goods, without statement of reasons.
In the case of a return of goods the cstomer is required to assume all costs incurred if the delivered goods correspond to the ordered goods. If goods have been culpably damaged or reduced in value, the customer must bear the costs of compensation.

8. Cancellation of Event

In case of a cancellation or postponement of the event, the customer must return the tickets immeadiately, at the latest within 14 days of the initial event date, to the cosmopop GmbH.
The customer will be reimbursed for the full price of the ticket, provided the original ticket is returned to the cosmopop GmbH and was also ordered there. There will be no refund in the case of a loss of the ticket.

9. Data Protection and Handling

The data necessary for the ordering of goods will be recorded internally and treated with the utmost confidentiality. No data of any kind will be passed on to a third party.
Furthermore, if the customer does not expressly object the cosmopop GmbH is entitled to process and use the thusly obtained data for the couselling of customers, for advertising purposes, for market research for proprietary purposes and for the efficient creation of offers to meet specific requirements. This consent may be witdrawn at any time without statement of reasons.

10. Final Provisions

Should any part of these terms and conditons be termed invalid or ineffective, the efficacy of the contract and/or the remaining terms and conditions remains unaffected.
This contractual agreement shall be subject to the laws of the Federal Republic of Germany exclusively.
Place of jurisdiction if the domicile of the cosmopop GmbH exclusively, provided that the customer is a registered trader or corporate body under public law. This contractual agreement shall be subject to the laws of the Federal Republic of Germany exclusively.

Terms and Conditions Time Warp Contest on Facebook

as of March 2012

The following terms and conditions apply for the Time Warp Facebook
Promotion „Win Time Warp Tickets“ and by participation, entrants’ warrant that they have read, understood and agreed to be bound by them.

1. Duration

Entries will be taken from March 3rd – March 26th 2012.
Cosmopop reserves the rights to end the promotion without any notice.

2. Eligibility

Only persons 18‐years and older are eligible to participate.

3. Method of Entry

Recommend the competiotion via the application to at least one person from your facebook friendlist. The participant confirms that the information provided is true. Only fully completed entries are eligible.

4. Selection

Winners will be selected via an electronic raffle draw and contacted via E-Mail. Winners will also be published on the Time Warp facebook page www.facebook.com/timewarpofficial.

5. Prizes

Prizes unclaimed after until the 30.03.2012 will be deemed forfeited. Prizes will not be converted to its cash equivalent.

6. Publicity Materials

By entering this competition, the entrant accepts that Cosmopop GmbH has the right to publish the name, image/photo of the winners for any promotional activities, e.g. announcement of winners on websites, press releases. The entrant accepts that the Application writes on his Facebook Timeline.

7. Release and Indemnity

To the extent permitted by, law, all entrants release from and indemnify Cosmopop GmbH against all liability, cost, loss or expense arising out of acceptance of any prize(s) or participation in the competition including loss of income, loss of opportunity, personal injury and damage to property whether direct of consequential, foreseeable, due to some negligent act or omission or otherwise.
Cosmopop GmbH accepts no responsibility for any late, lost or misdirected entries.

8. Exclusion of Participants

No employee of Cosmopop GmbH, their agencies or their immediate family members is allowed to participate in this competition. Entrants who do not comply with the competition rules, or attempt to interfere with this sweepstakes in any way shall be disqualified.

9. Sponsor

The Competition is run by Cosmopop GmbH.
